Terms of Service

These Terms & Conditions (“Terms”) govern your use of the 4040 Campaign platform, website, app, and any related services (collectively, the “Service”), operated by the 4040 Campaign Team (“we”, “our”, or “us”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Eligibility

You must be at least 18 years old to create an account or participate in the Campaign. By signing up, you represent that you meet this requirement. The Service is intended for residents of Canada and the United States. Use of the platform is void where prohibited by law.

Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. The Service is intended to promote community engagement, facilitate campaign participation, and track visits to participating businesses for contest purposes and tourism data collection. You are responsible for maintaining the confidentiality of your account login credentials and for any activity under your account.

Prohibited Uses

As part of our Acceptable Use Policy, the following activities are strictly prohibited: submitting fraudulent scans (e.g., scanning without physically visiting, using bots, or falsifying spending amounts); attempting to scrape, crawl, or harvest data from the platform without permission; providing false identity or information; disrupting the experience of other users, businesses, or the integrity of the prize draw; reverse engineering, decompiling, or attempting to gain unauthorized access to our systems or codebase. Violation of these rules may result in immediate suspension or termination of your account and disqualification from any promotions or prize draws, at our sole discretion.

Intellectual Property

All content, branding, and platform design associated with the 4040 Campaign are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without express written consent.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any damages arising out of or related to your use of (or inability to use) the Campaign website, including but not limited to data loss, personal injury, prize disputes, or business outcomes. We do not guarantee uninterrupted or error-free access.

Privacy

Your use of the Service is subject to our Privacy Policy. We collect and process your information only for the purpose of administering the 4040 Campaign, collecting data for tourism development purposes and contacting winners. We do not sell or share your personal data with third parties without your consent.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes or legal claims arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the courts of Ontario, Canada.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after any updates constitutes your acceptance of the new Terms. The effective date at the top of this page will reflect the latest version.
